Terms of service

1. Provider and scope
FISP Radar is provided by Christoph Ploner, Eisenstadt, Austria (see Imprint). The service is offered exclusively to businesses; consumers may not subscribe.
2. The service
We provide lists, an online subscriber area and reports derived from public datasets of the City of New York (Department of Buildings facade filings and filing status, HPD registration data, PLUTO), including an assignment of buildings to the sub-cycles of the Facade Inspection & Safety Program and a priority ranking. The service is an information service. It is not legal, engineering or compliance advice, it does not create any relationship between you and any building owner, and it does not constitute a referral or recommendation of your firm to any owner. FISP Radar is not affiliated with the New York City Department of Buildings.
3. Accuracy
The data is derived from government datasets as published, which may be incomplete, late or incorrect, and from rules (including the sub-cycle rule in 1 RCNY 103-04) that the City may change. We describe our method and the data date on every list but do not guarantee that any building is due on a given date, that it has or has not filed, or that any owner will engage an inspector. Verify every filing in DOB NOW before you act.
4. Permitted use
You may use the data for your own firm's business development. You may not resell, publish or redistribute the lists, and you may not publish or quote to third parties the name of a prior inspection firm shown for a building. When contacting owners or managing agents you are responsible for complying with applicable law and professional rules, including the CAN-SPAM Act, the Telephone Consumer Protection Act and 8 NYCRR Part 29 (advertising, referral fees and fee splitting). Our price is a flat subscription fee for data; it is not contingent on and not related to any engagement you may win.
5. Purchase, payment and term
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders and handles customer service inquiries and returns relating to payment. Prices are shown on the website; Paddle may add applicable taxes.
Cycle passes run from purchase to the end date shown for the package (currently March 31 of the year after the sub-cycle deadline) and do not renew. The annual package runs for 12 months from the start date and renews unless you switch off renewal before the renewal date. Founder prices apply to purchases made by the date shown on the website and stay fixed when you renew or buy the next cycle pass.
6. Money-back guarantee
If you are not satisfied, you may request a full refund by e-mail to hello@fispradar.com within 30 days of your first purchase. No reason is required. The refund is made to the original payment method through our payment provider; access then ends and updates stop.
7. Liability
We are liable without limitation for intent and gross negligence. For slight negligence our liability is excluded to the extent permitted by law and in any case limited to the fees you paid in the 12 months before the claim. We are not liable for decisions you take on the basis of the data, including missed or misjudged deadlines.
8. Law and venue
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is Eisenstadt, Austria.
